Delta-8 back to Schedule 1 status in Texas

AUSTIN, Texas — The Texas Supreme Court reversed a temporary injunction against the Department of State Health Services, which had placed delta-8 on the list of Schedule 1 substances in 2021 but been successfully challenged by delta-8 vendors. The agency has sovereign immunity from suit but the vendors did have standing to sue, leaving the door open to future legal action.
